TERMS AND CONDITIONS OF BOOKING AND RENTAL

LANDYCAMPERS

SPRING 2026

 

Thank you for choosing to book a hire vehicle from LandyCampers. Please read the following Terms and Conditions carefully as, together with the Booking Confirmation, the Rental Agreement and the LandyCampers Handbook they set out each party's respective rights and responsibilities and form the basis of your contract with us.

If there is anything you do not understand, please get in touch before paying the booking deposit. By paying the booking deposit to secure your booking you confirm you have read these Terms and Conditions and agree to them. If you subsequently fail to satisfy any of the conditions laid out in the documents, you may forfeit the booking deposit and further non-refundable fees and the contract may be cancelled.

  1. Definitions and Interpretation

In these Terms and Conditions, the following term shall have the following meanings:

"Booking Offer" refers to the offer made by us to hire a Vehicle to you for the dates and Hire Price detailed in the offer;

"Booking Confirmation" refers to the confirmation sent to you from us confirming the booking for the hire of the Vehicle;

"Damage Deposit" refers to the deposit payable by you at the commencement of the Hire Period as partial security against breakages, damage to the Vehicle, Insurance Excess charges and any other costs arising from your hire;

"Driver" refers to the person or persons authorised by us and our insurer to drive the Vehicle during the Hire Period;

"Excess Mileage Charges" refers to the charge for excess miles driven by you calculated in accordance with clause 18 below;

"Hire Charge" refers to the price for the hire of a Vehicle which shall be stated on the Booking Offer and the Booking Confirmation;

"Hire Period" refers to the period that you have agreed to hire the Vehicle as stated in the Booking Offer and Booking Confirmation;

"Hirer", "you", "your" and "yours" are references to you the person hiring the Vehicle from us and who is named on the Booking Offer and Booking Confirmation;

"Insurance Excess" refers to the amount of £750 payable by the Hirer in respect of each and every incident giving rise to a claim under our motor insurance policy, regardless of fault;

"LandyCampers Handbook" refers to the handbook that we provide to you at the beginning of the Hire Period;

"Rental Agreement" refers to the agreement which you are required to enter into to hire a Vehicle from us;

"Terms and Conditions" refers to this document which shall govern your booking of a Vehicle from us;

"Vehicle" refers to the Land Rover Defender (which shall include any ancillary equipment included in the vehicle) which you have agreed to hire from us for the Hire Period; and

"we", "us" and "our" refers to LandyCampers which is a trading name of Max Isham and Bela Böhme.

2 Booking Offer and Booking Deposit

2.1 Once we receive your completed booking request, then subject to Vehicle availability, you will receive a Booking Offer from us which will detail the Hire Charge for the Vehicle. The price will be valid for 14 days from the date stated on the Booking Offer.

2.2 In order to confirm a booking, a non-refundable deposit of 25% of the total quoted Hire Charge is required, which will be deducted from the overall Hire Charge. Booking deposits must be paid by credit or debit card. Upon receipt of the booking deposit the Vehicle is secured for your requested dates and LandyCampers will issue a Booking Confirmation e-mail, together with an invoice showing the balance of the Hire Charge due and any Damage Deposit.

2.3 Upon receipt of the Booking Confirmation, please check the booking details and inform us immediately of any discrepancies. In particular, you should ensure that the collection and return times are correct as charges will be applied in the event of late collection or return of the Vehicle.

3 Hire Charges

3.1 The Hire Charge is calculated on a per night basis and shall be as stated in the Booking Offer and Booking Confirmation. The Hire Charge includes the daily rental charge for a Vehicle, vehicle tax and value added tax, breakdown assistance, a mileage allowance of 125 miles per day and comprehensive motor insurance.

3.2 The balance of the Hire Charge is due for payment no less than 28 days prior to the start of the Hire Period and must be paid by credit or debit card. The credit or debit card used to make the payment must always be in the name of the main driver and must be presented at the pick-up of the Vehicle. Cash, cheque, and pre-paid credit cards are not accepted.

3.3 If you fail to pay the full cost of rental 28 days prior to start of the Hire Period then the booking may be cancelled, and cancellation fees will apply.

3.4 All Hire Charges are quoted and payable in UK pounds sterling.

3.5 The Vehicle will be provided with a full tank of fuel at the start of the Hire Period and must be returned with a full tank. If the Vehicle is returned without a full tank, we will refuel it and charge you the cost at the prevailing local pump rate plus a £20 administration fee. This charge will be deducted from the Damage Deposit or charged to your card on file.

 

4 Damage Deposit and Insurance Excess Liability

4.1 At the commencement of the Hire Period you must pay a Damage Deposit of £250 by credit or debit card in the name of the Hirer. The Damage Deposit is a cleared payment, not a pre-authorisation. We do not accept cash.

4.2 The Damage Deposit is partial security against any costs arising from your hire. You acknowledge and agree that your total liability under this clause is not limited to the Damage Deposit. In particular, in the event of any incident giving rise to a claim under our motor insurance policy, you are liable for the full Insurance Excess of £750 per incident, regardless of fault. The Damage Deposit represents partial security against this liability.

4.3 The Damage Deposit will be refunded at our discretion following the safe return of the Vehicle to us at the end of the Hire Period, provided the Vehicle is returned in good working order and in the condition in which it left us.

4.4 In the event of:

  • any breakages, damages or losses to the Vehicle or equipment whether or not covered by our insurance;

  • Insurance Excess charges;

  • Excess Mileage Charges;

  • motor fines and parking charges;

  • late return fees calculated in accordance with clause 15 below;

  • fuel re-fill charges calculated in accordance with clause 3.5;

  • cleaning or valeting charges in accordance with clause 12;

  • smoking or vaping remediation charges in accordance with clause 9;

  • any other costs we incur as a result of your use of the Vehicle,

you authorise us to deduct these costs from the Damage Deposit before the balance is returned to you.

4.5 Where costs arising under clause 4.4 exceed the Damage Deposit, you will be liable to pay us the additional costs incurred and you authorise us to charge such costs against the credit or debit card you used to make the Damage Deposit or the booking payment. We will provide reasonable documentary evidence to support all costs incurred by us.

4.6 We reserve the right to retain the Damage Deposit for such period as is necessary to quantify any charges incurred before deducting them and returning any balance. We will endeavour to process any refund to which you may be entitled as soon as reasonably practicable, bearing in mind that third party claims can take some time to resolve.

 

5 Driver Requirements

5.1 Each nominated Driver of the Vehicle must:

  • be between 25 and 75 years old;

  • have held a full driving licence for a minimum of 2 years. We accept driving licences issued in the UK, EU, Australia, United States, Canada, New Zealand and South Africa;

  • not have been convicted of or have any charges pending for any driving ban or disqualification offence, or hold a BA, DD or UT conviction;

  • not have been involved in more than one fault incident within the last 3 years;

  • not have more than two convictions carrying a maximum of 3 points each. Single convictions of 4 points or fewer are acceptable. Single 6-point SP30, SP50 or CU80 convictions may be accepted subject to a double excess. All other convictions carrying 6 or more points require referral to our insurers;

  • never have had motor insurance declined, renewal refused, special terms imposed or motor insurance cancelled by any insurer;

  • be legally permitted to drive the Vehicle and not have been advised on medical grounds not to drive;

  • be a named driver on the Booking Confirmation.

5.2 Drivers not meeting these requirements will be referred to our insurer for acceptance and you will be notified if permission is declined for that Driver. Permission to drive must be received from us prior to commencement of the Hire Period. We may decline or withdraw permission for a Driver to drive the Vehicle at our sole discretion.

 

6 Identity Check and Necessary Documents

6.1 UK Drivers

6.1.1 No later than 48 hours prior to the commencement of the Hire Period, each named Driver on the Booking Confirmation must obtain a DVLA licence 'check code' which must be provided to us so that we can view your driving record. To generate a code you will need to visit https://www.gov.uk/view-driving-licence and follow the steps set out to "Share Your Licence Information".

6.1.2 Upon collection of the Vehicle each Driver must present:

  • their photo-card UK driving licence (address and personal details must be up to date);

  • two proofs of address from separate sources, in the form of a utility bill, bank statement, council tax bill, credit card statement, mortgage statement or letter from a Government department. Council tax bills are accepted annually; all other documents must be dated within 90 days of the hire date. The name and address on both documents must match the address on the photo-card driving licence.

6.1.3 It is your responsibility to ensure that the DVLA licence check code, photo-card driving licence and proofs of address are provided at the requisite times. Failure to do so may result in our declining a Driver and/or the cancellation of the hire and the loss of all Hire Charges.

6.2 Overseas Drivers

6.2.1 Drivers holding a full driving licence issued in the EU, Australia, United States, Canada, New Zealand or South Africa are accepted as standard, provided they meet the criteria in clause 5.1 and can provide the relevant documentation.

6.2.2 Upon collection of the Vehicle each overseas Driver must present:

  • their passport or national identification card;

  • their full driving licence;

  • two proofs of address from the categories listed in clause 6.1.2.

6.2.3 EU licence holders who have been living in the UK for less than 12 months must additionally provide their passport alongside two proofs of address.

6.2.4 Drivers holding licences issued in countries not listed in clause 6.2.1 will be referred to our insurers. Cover cannot be confirmed until acceptance is received.

6.2.5 In some circumstances, our insurance company may request further documentation regarding your driving history.

 

7 Additional Driver

An additional driver, if meeting the criteria set out in clause 5 and adhering to the requirements set out in clause 6, can be added for a surcharge of £10 per day.

 

8 Driving and Using the Vehicle

8.1 During your possession of the vehicle you must:

  • only use the Vehicle according to the road traffic laws and all laws and regulations for using the Vehicle and any Optional Extras;

  • use the correct fuel;

  • drive the Vehicle with all due care and attention;

  • only use the vehicle on surfaces that are legally classed as roads;

  • acknowledge that we may reserve the right to restrict the vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause.

8.2 You must not:

  • use the vehicle for any business purposes, carriage of goods for money, fast food deliveries, hawking, dealing or general trading, street or market trading;

  • take the vehicle outside the United Kingdom without our prior written consent. Where consent is given, travel within the EU is covered by our insurance and breakdown policies, and we will arrange the necessary VE103 certificate. You must notify us of your intended travel dates and destinations at the time of booking;

  • allow the vehicle to be driven by any unidentified person not mentioned in the rental agreement;

  • allow the vehicle to be used for any illegal or dangerous purpose, race, contest or performance test of any kind or for hire, reward or driver training;

  • submerge the vehicle in water, bring it into contact with saltwater, or drive through flooded areas or on beaches;

  • use the vehicle extensively on unsealed, unsurfaced or unclassified roads or 'green lanes', unless we have given you written permission to do so;

  • use the vehicle to tow or push anything;

  • use the vehicle to carry volatile liquids, gases, explosives or other corrosive or inflammable material or use the vehicle for the purpose of transporting goods other than what might be reasonably expected of a leisure rental or that would overload the vehicle;

  • undertake any alterations or additions to the vehicle (incl. racks or accessories) or have installed any branding, advertisement, marks or paintwork to the vehicle;

  • exceed the speed limit, and/or exceed 65mph where a roof tent is fitted to the vehicle;

  • drive the vehicle in any way that could cause damage or strain to the engine or clutch;

  • take the vehicle to music festivals or any other festivals / events without our prior written consent.

Please be aware that our vehicles are fitted with tracker devices. These live-track and record their movements for the purpose of maintaining and protecting the vehicle.

 

9 Smoking, Vaping and Pets

9.1 Smoking and vaping are strictly prohibited inside the Vehicle and inside any roof tent or other equipment provided with the Vehicle. A cleaning and remediation charge of £200 will be applied and deducted from the Damage Deposit (or charged to your card on file) if evidence of smoking or vaping is found upon return.

9.2 Dogs are only permitted in the Vehicle if you have purchased our Dog Pack add-on at the time of booking. The Dog Pack covers reasonable cleaning associated with travelling with a small to medium sized dog. Large or giant breed dogs are not permitted without our prior written consent.

9.3 Dogs must not be left unattended in the Vehicle at any time. Dogs are not permitted on the vehicle seats or inside the roof tents. You are responsible for any damage caused by your dog to the Vehicle, roof tents, or equipment beyond what is covered by reasonable cleaning under the Dog Pack.

 

10 Vehicle Condition, Inventory and Cleaning

10.1 At the commencement of the Hire Period, a joint condition report and equipment inventory will be completed and signed by both parties, supported by photographic evidence. This record will form the basis for assessing any damage or loss upon return.

10.2 You are not required to return the Vehicle in a professionally cleaned condition. However, all rubbish must be removed and the Vehicle must be free from any unhygienic waste. Cooking equipment should be rinsed and food waste disposed of.

10.3 If the Vehicle is returned in an excessively soiled condition (at our reasonable discretion), a valeting charge of £60 will be applied and deducted from the Damage Deposit or charged to your card on file.

10.4 An equipment inventory with replacement values will be provided with the Vehicle at the start of the Hire Period. You are liable for the replacement cost of any items that are missing or damaged beyond reasonable wear and tear upon return of the Vehicle.

 

11 Roof Tents and Specialist Equipment

11.1 The roof tents supplied with the Vehicle must only be erected, operated, and stowed in accordance with the instructions provided in the LandyCampers Handbook. You must not exceed 65mph at any time when a roof tent is fitted to the Vehicle.

11.2 You are liable for any damage to the roof tents, their fabric, zips, poles, ladders, or mounting hardware caused by improper use, failure to follow the provided instructions, or by driving in excess of the stated speed limit.

11.3 Roof tents must be fully closed and securely stowed before the Vehicle is driven. Damage resulting from driving with a roof tent in an open, partially open, or improperly secured position is your responsibility and will not be covered by our insurance.

 

12 Accident and Vehicle Damage

12.1 In the event of an accident or vehicle damage you must:

  • under all circumstances notify the police and follow the further instructions in the LandyCampers Handbook;

  • if the vehicle cannot be driven after an accident, a replacement vehicle is not assured and is subject to availability, location and remaining hire duration.

12.2 Subject to your liabilities and Terms and Conditions not being breached, if a replacement vehicle is not supplied, we will refund your hire fees for any whole days for which you lose total use of the Vehicle.

12.3 If the vehicle cannot be recovered or is unsafe to drive the same day, our breakdown cover with Call Assist may offer assistance. The 24-hour breakdown number is 01603 216 366. Please refer to the breakdown information provided with the Vehicle.

12.4 You accept that we will not be liable to pay any compensation or cover other costs, losses or expenses resulting from an accident (such as loss of opportunity, cost of flights etc.). You may decide to take out separate insurance to cover aspects of your hire that are not covered by our insurance.

 

13 Theft

13.1 In the event of the vehicle, keys or any equipment being stolen, you must:

  • under all circumstances notify the police immediately and obtain a police report or crime reference number and follow the further instructions in the LandyCampers Handbook.

13.2 We will have no responsibility or liability for the loss, theft or damage to any personal belongings left in the Vehicle at the time it was stolen. Please take out your own insurance covering such losses.

13.3 Theft involving deception: if either the keys cannot be provided, or the theft was a result of keys remaining in the Vehicle whilst it is unoccupied, the damage is not covered by the insurance.

 

14 Insurance and Vehicle Breakdown Cover

14.1 The Hire Charge includes the provision of comprehensive vehicle insurance and roadside assistance cover (UK and European) during the Hire Period.

14.2 A summary of what is and is not covered by the insurance is set out in Annex I to these Terms and Conditions. Full policy documentation is available on request.

14.3 In the event of any incident or accident, you are liable for the Insurance Excess of £750 for each and every incident, regardless of who is at fault. The Insurance Excess will be deducted from your Damage Deposit in the first instance, and any balance will be charged to the card on file. The Insurance Excess will be refunded only if we are successful in recovering the cost of damages from a third party. Please note that third party claims can take months or even years to resolve.

You are strongly advised to take out additional travel insurance as you may be able to claim against it for such exclusions should the need arise.

 

15 Cancellations and Refunds

15.1 If you wish to cancel the booking you may do so at any time by contacting us by e-mail or telephone. We will confirm the cancellation in writing to you. The cancellation will take effect on the day we receive it. Upon receipt of notice of your cancellation or termination, the following shall apply:

  • If cancelled 90 days or more prior to the start of the Hire Period: the booking deposit will be refunded in full to you.

  • If cancelled 89 to 28 days prior to the start of the Hire Period: you will not be entitled to a return of the booking deposit which shall act as our cancellation fee.

  • If cancelled less than 28 days prior to the start of the Hire Period: you will not be entitled to a refund of the Hire Charge paid.

15.2 Before you enter into this Agreement you may wish to consider taking out separate travel insurance to cover you for costs incurred in the event of a cancellation. It is your responsibility to ensure that the travel insurance you purchase is suitable and adequate for your particular needs.

 

16 Duration of Hire Period and Late Return Fees

16.1 The Hire Period shall run for the number of hours, days and nights shown on the Booking Confirmation. You will be required to pick up the Vehicle at the location and at the date and time specified in the Booking Confirmation. At the beginning of the Hire Period you will receive the Vehicle in a clean condition and in sound and safe working order, with a full tank of fuel.

16.2 You must return the Vehicle to the agreed return location specified on the Booking Confirmation by the return date and time. The insurance cover provided with the booking will not cover you outside the agreed Hire Period.

16.3 Failure to return the Vehicle on the agreed date and time and in the same condition at the start of the Hire Period means that you will be in breach of these Terms and Conditions. You will be liable to pay a late return fee which shall be calculated as follows:

  • Return the Vehicle within 3 hours after the 45-minute grace period from the agreed return date and time: a £20 late charge will be deducted from the Damage Deposit.

  • Return the Vehicle any time after 3 hours from the agreed return date and time: a Hire Charge for a full day will be deducted from the Damage Deposit.

16.4 When planning your return trip please always allow for delays due to traffic jams or diversions. Please get in touch with us as soon as you become aware of your delay. Late pick-ups or earlier drop-offs do not entitle the Hirer to any refund of the unused portion of the Hire Charge.

16.5 The Vehicle must be returned in accordance with the LandyCampers Handbook.

16.6 Some damage to the Vehicle may not be apparent at the post-hire inspection, such as mechanical damage (for example in areas such as the engine, fuel tank or clutch) or damage hidden by adverse light or weather conditions. If we find any such damage after the Vehicle has been returned, we will notify you in writing and provide you with suitable evidence of the same.

16.7 You shall continue to remain responsible for the Vehicle and its equipment until such time as it has been returned to us and we have carried out a post-hire inspection and declared the Vehicle off-hire.

 

17 Vehicle Availability

We will use our reasonable endeavours to ensure that you have the Vehicle you have chosen. However, it will be appreciated that due to unforeseen circumstances such as an accident with the Vehicle, we cannot guarantee that the exact Vehicle that you have chosen will always be available. In the unlikely event that your reserved Vehicle is not available, we will make every effort to provide a similar or better vehicle. In the event that it is not possible to offer you an alternative Vehicle or the alternative Vehicle is not acceptable to you we shall refund you any monies already paid by you. This shall be your sole remedy in such circumstances.

 

18 Excess Mileage

The Hire Charge includes up to 125 miles per day averaged over the duration of your Hire Period. If you exceed this limit we shall be entitled to charge for excess miles as follows:

  • £0.40 per mile in excess of 126–250 miles per day;

  • £0.60 per mile for each mile in excess of 251 miles per day.

19 Your Responsibilities

19.1 It is your responsibility to ensure that during the Hire Period you always comply with the LandyCampers Handbook, these Terms and Conditions, the Booking Confirmation and the Rental Agreement. You must operate the Vehicle only in accordance with the manufacturer's instructions and manual and the LandyCampers Handbook.

19.2 You must not take the Vehicle outside of the United Kingdom without our prior written consent in accordance with clause 8.2.

 

20 Our Responsibilities and Liability to You

20.1 We shall use our reasonable endeavours to ensure that:

  • the Vehicle made available to you at the beginning of the Hire Period has been maintained in accordance with the manufacturer's recommendations;

  • the Vehicle is roadworthy and suitable for hire at the start of the Hire Period.

20.2 USE OF THE VEHICLE IS ENTIRELY AT YOUR OWN RISK AND YOU SHOULD SATISFY YOURSELF THAT YOU ARE COMPETENT TO USE THE VEHICLE.

20.3 IF WE ARE FOUND LIABLE FOR ANY LOSS OR DAMAGE TO YOU SUCH LIABILITY IS LIMITED TO THE AMOUNT YOU HAVE PAID FOR THE HIRE OF THE VEHICLE. WE EXCLUDE LIABILITY FOR LOSSES THAT WERE NOT FORESEEABLE TO BOTH PARTIES WHEN THE CONTRACT WAS FORMED AND LOSSES THAT WERE NOT CAUSED BY ANY BREACH ON OUR PART. THIS LIMITATION OF LIABILITY DOES NOT APPLY TO PERSONAL INJURY OR DEATH ARISING AS A DIRECT RESULT OF OUR NEGLIGENCE.

20.4 THE VEHICLES HIRED BY US ARE PROVIDED FOR PRIVATE USE ONLY. ACCORDINGLY, WE DO NOT ACCEPT LIABILITY FOR ANY LOSS OF DATA, LOSS OF INCOME OR PROFIT, LOSS OF DAMAGE TO PROPERTY AND/OR LOSS FROM CLAIMS OF THIRD PARTIES ARISING OUT OF THE USE OF THE VEHICLES HIRED FROM US.

20.5 WE SHALL NOT BE HELD LIABLE FOR ANY FAILURE OR DELAY IN PROVIDING THE VEHICLE WHERE SUCH FAILURE ARISES AS A RESULT OF ANY ACT OR OMISSION WHICH IS OUTSIDE OUR REASONABLE CONTROL SUCH AS AN ACT OF GOD OR THOSE OF THIRD PARTIES.

20.6 WE SHALL NOT BE LIABLE FOR ANY MISREPRESENTATIONS OTHER THAN FRAUDULENT MISREPRESENTATIONS.

We strongly recommend that you take out separate travel insurance and ensure that it provides adequate cover for your hire of the Vehicle.

 

21 Force Majeure

21.1 Neither party shall be liable for any failure or delay in performing their obligations under these Terms and Conditions where such failure or delay results from circumstances beyond that party's reasonable control, including but not limited to severe adverse weather, natural disaster, fire, flood, epidemic or pandemic, government action or restriction, road closures, civil unrest, strike or industrial action, or mechanical failure of the Vehicle not attributable to neglect by either party.

21.2 If we are unable to provide the Vehicle due to a force majeure event, we will use reasonable endeavours to offer you alternative dates. If alternative dates are not acceptable to you, we will refund all monies paid by you, less any irrecoverable costs already incurred by us. This shall be your sole remedy in such circumstances.

21.3 If a force majeure event occurs during the Hire Period that prevents you from using the Vehicle or returning it on time, you must notify us as soon as reasonably practicable. We will not apply late return fees where the delay is directly caused by a force majeure event, provided you can demonstrate the cause of the delay.

 

22 Termination of the Booking or the Rental Agreement

22.1 You acknowledge that we may terminate your booking and/or the Rental Agreement with immediate effect and repossess the Vehicle in the circumstances set out below. In such circumstances you will indemnify us for the costs of repossessing the Vehicle and have no right to a refund of any part of the Hire Charges or the Damage Deposit if:

  • you are in breach of any term of these Terms and Conditions or the Rental Agreement;

  • you have obtained the Vehicle through fraud or misrepresentation;

  • the Vehicle appears to be abandoned;

  • the Vehicle is not returned at the end of the Hire Period on the agreed return date or we reasonably believe that the Vehicle will not be returned on the agreed return date;

  • we consider, on reasonable grounds, that the safety of passengers or the condition of the Vehicle is endangered.

22.2 In the event that you fail to pay the balance of the Hire Charge due prior to start of the Hire Period in accordance with the Booking Confirmation, we shall cancel the booking and you shall not be entitled to a refund of the booking deposit.

 

23 Risk and Ownership of the Vehicle

23.1 Full ownership in the Vehicle shall remain fully vested in us at all times. You have no right, title or interest in the Vehicle other than that you are entitled to hire the Vehicle for the Hire Period.

23.2 You are responsible for the Vehicle from the time you collect the Vehicle until the time you return the Vehicle to us. Full risk in the Vehicle shall lie with you during this time.

23.3 You are not permitted to hire, sub-let, sell, lend, or part with possession of the Vehicle at any time during the Hire Period.

23.4 You hereby indemnify us against any losses, costs, damages or expenses that we may reasonably incur as a result of your breach of any of these Terms and Conditions.

 

24 General

24.1 We may subcontract any part or parts of the hiring of the Vehicle that we provide to you from time to time and we may assign or novate any part or parts of our rights and obligations under these Terms and Conditions and the Rental Agreement by giving you written notice.

24.2 These Terms and Conditions, the Booking Confirmation, Rental Agreement and the LandyCampers Handbook constitute the entire contract between you and us. No other terms, statements, representations or promises whether expressed or implied shall form part of our contract. In the event of any conflict between these Terms and Conditions and any document, the following order of precedence shall prevail:

  • the Rental Agreement;

  • the Terms and Conditions;

  • Booking Confirmation; and

  • LandyCampers Handbook.

24.3 If any term or condition of our contract shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the contract shall continue in force without such term or condition.

24.4 These Terms and Conditions and the Rental Agreement shall be governed by and construed in accordance with the relevant English law. The parties hereto submit to the exclusive jurisdiction of the relevant courts of England and Wales.

24.5 No delay or failure on our part to enforce our rights or remedies under the contract shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.

DATA PROTECTION AND ACCEPTANCE

By paying the booking deposit you confirm that you have read and agree to these Terms and Conditions.

In connection with the booking and hire of a Vehicle, we collect, process and store personal data including your name, address, contact details, driving licence information, DVLA check results, proof of address documentation, payment details, and vehicle tracker data. We process this data on the following bases:

  • contractual necessity: to perform our obligations under the hire agreement;

  • legal obligation: to comply with our insurance and road traffic law requirements;

  • legitimate interest: to protect our vehicles and manage our business.

We may share your personal data with our insurance provider (Markerstudy Insurance Services Limited, via Alan Boswell Insurance Brokers), breakdown provider (Call Assist Limited), payment processors, and with third parties such as the police or parties involved in an accident where required.

We will retain your hire-related personal data for a period of 7 years following the end of the Hire Period to satisfy our legal, insurance, and accounting obligations.

Your full privacy rights, including your rights of access, erasure, and portability, are set out in our Privacy Policy at www.landycampers.co.uk/terms-conditions.

If you breach this agreement, we may share your information with the Driver and Vehicle Licensing Authority (DVLA) and the British Vehicle Rental and Leasing Association (BVRLA), who may pass it on to their members for the purposes of risk assessment.

Nothing in these Terms and Conditions affects your statutory rights under the Consumer Rights Act 2015.

Your agreement to these Terms and Conditions will be reconfirmed by you in person when you sign the Rental Agreement at the commencement of the Hire Period.

ANNEX I — INSURANCE SUMMARY

Your hire includes comprehensive motor insurance underwritten by Tradex Insurance Company Limited, arranged through Markerstudy Insurance Services Limited via Alan Boswell Insurance Brokers Ltd. The following is a summary only; full policy documentation is available on request.

What is insured:

  • Loss of or damage to the Vehicle caused by accident, malicious damage, vandalism, fire, lightning, explosion, theft or attempted theft

  • Unlimited cover for death or injury to third parties

  • Damage to third party property up to £5,000,000

  • Personal accident benefits up to £5,000 (death) / £5,000 (loss of sight or limb)

  • Personal belongings up to £200

  • Medical expenses up to £200 per person

  • Emergency transport and accommodation up to £500 per incident

  • Replacement locks up to £500

  • European use (with prior arrangement and VE103 certificate)

  • Roadside assistance, nationwide recovery, home assist and European breakdown cover via Call Assist

What is not insured (key exclusions):

  • The Insurance Excess of £750 per incident, regardless of fault

  • Driving without a valid licence or not complying with its conditions

  • Loss or damage from wear and tear, electrical or mechanical breakdown

  • Driving under the influence of alcohol or drugs

  • Theft where keys have been left in or on the Vehicle, or the Vehicle has been left unsecured

  • Loss or damage caused by use of incorrect fuel

  • Damage caused deliberately by the hirer or any person in charge of the Vehicle

  • Loss or damage while the Vehicle is used for purposes not permitted by the policy

  • Use on racetracks, circuits, or the Nurburgring Nordschleife

  • Any trip exceeding 90 days

Sales Terms & Conditions

1. Introduction

1.1. These Terms and Conditions govern the sale of products ("Products") on the LandyCampers website ("Website"). By placing an order through the Website, you agree to be bound by these Terms and Conditions.

2. Definitions

2.1. "We", "Us", "Our" refers to LandyCampers, the seller of the Products.
2.2. "You", "Your" refers to the buyer or customer placing an order through the Website.
2.3. "Order" refers to the request made by You to purchase Products from Us through the Website.

3. Ordering

3.1. By placing an Order through the Website, You warrant that You are at least 18 years old and legally capable of entering into binding contracts.
3.2. All Orders are subject to availability and acceptance by Us. We reserve the right to refuse or cancel Orders at Our sole discretion, for any reason, without liability.
3.3. Upon receipt of Your Order, We will send You an order confirmation email detailing the Products ordered and estimated delivery dates.

3.4 Our acceptance of Your Order takes place upon dispatch of Your Order

3.5 We may refuse to accept an Order: (a) where goods are not available; (b) where we cannot obtain authorisation for your payment; (c) if there has been a pricing or product description error; (d) if you do not meet any eligibility criteria set out in our terms and conditions.

4. Price and Payment

4.1. The price of the Products is as stated on the Website and is inclusive of VAT (where applicable) at the current rate and delivery charges, unless otherwise specified.
4.2. Payment for Orders must be made in full at the time of placing the Order. We accept payment via the payment methods available on the Website.
4.3. We reserve the right to change the prices of Products at any time without prior notice, but such changes will not affect Orders for which We have already sent an order confirmation.

5. Delivery

5.1. We will deliver the Products to the address specified in Your Order. Delivery times may vary depending on Your location and the availability of the Products.
5.2. Risk of loss or damage to the Products shall pass to You upon delivery.
5.3. If You fail to accept delivery of the Products or fail to provide adequate delivery instructions, We may charge You for any additional delivery costs incurred.

6. Returns and Refunds

​

6.1. If You wish to return a Product for any reason, You must notify Us within 14 days of receiving the Product and return it to Us within 30 days of receipt.
6.2. Returned Products must be unused, in their original packaging, and in a resalable condition. We reserve the right to refuse returns that do not meet these criteria.
6.3. Upon receipt of the returned Product, We will issue a refund to the original payment method within 14 days.

7. Warranty

7.1. All Products are covered by the manufacturer's standard warranty. Please refer to the warranty information provided with the Product for details of coverage and exclusions.

8. Liability

​

8.1. Our liability to You in connection with the sale of Products shall be limited to the purchase price of the Products.
8.2. We shall not be liable for any indirect or consequential loss or damage arising out of or in connection with the sale of Products.

9. Governing Law

9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
